Terms of Service

1. Agreement

By creating an account or using PromoForge, you agree to these Terms of Service. PromoForge is operated by Funstar Digital (ABN 30 577 818 671). If you do not agree, do not use the service.

2. The Service

PromoForge is an AI-powered promotional content platform that helps you create, schedule, and distribute marketing content across social media platforms. The service includes:

• AI-generated promotional text and visual content
• Storyboard creation and video rendering
• Multi-platform scheduling and distribution
• Brand management tools
• Performance analytics

3. Accounts

You must provide a valid email address and create a password to use PromoForge. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.

One person or business may maintain multiple brand profiles within a single account.

4. Subscriptions & Billing

PromoForge offers tiered subscription plans billed monthly. Prices are listed in Australian Dollars (AUD) and include GST where applicable.

• Your subscription renews automatically each billing period
• You can cancel at any time — access continues until the end of the current billing period
• Refunds are not provided for partial billing periods
• We reserve the right to change pricing with 30 days' notice

Payment processing is handled by Stripe. By subscribing, you also agree to Stripe's terms.

5. Your Content

You retain ownership of all content you upload to PromoForge (brand assets, images, text, media). By using the service, you grant us a limited licence to process, store, and distribute your content as necessary to operate the platform.

You are responsible for ensuring you have the rights to any content you upload and distribute through PromoForge.

6. AI-Generated Content

Content generated by PromoForge's AI features (text, images, video) is provided for your use. You may use AI-generated content for commercial purposes within your subscription terms.

AI-generated content is provided "as is". While we strive for quality, we do not guarantee that AI output will be accurate, appropriate for all contexts, or free of errors. You are responsible for reviewing and approving all content before publication.

7. Platform Connections

When you connect third-party social media accounts, you authorise PromoForge to post content on your behalf according to your configured schedule and approvals. You can disconnect platforms at any time.

We are not responsible for changes to third-party platform APIs, terms, or policies that may affect service functionality.

8. Acceptable Use

You agree not to use PromoForge to:

• Create or distribute illegal, harmful, or deceptive content
• Violate any third-party platform's terms of service
• Infringe on intellectual property rights
• Spam, harass, or engage in abusive behaviour
• Attempt to reverse-engineer, exploit, or compromise the platform
• Resell access to the service without authorisation

We reserve the right to suspend or terminate accounts that violate these terms.

9. Usage Limits

Each subscription plan includes defined usage limits (content generations, renders, connected platforms). Usage beyond plan limits may be throttled or require a plan upgrade. Current limits are displayed in your account dashboard.

10. Service Availability

We aim to keep PromoForge available 24/7 but do not guarantee uninterrupted service. Maintenance windows, third-party outages, and unforeseen issues may cause temporary disruption. We will provide reasonable notice for planned maintenance.

11. Limitation of Liability

To the maximum extent permitted by Australian law:

• PromoForge is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the fees you paid in the 12 months preceding the claim
• We are not responsible for the performance or actions of third-party platforms

Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded.

12. Termination

You may close your account at any time. Upon closure:

• Your subscription is cancelled at the end of the current billing period
• Your data is deleted within 30 days (except where legally required)
• Connected platform authorisations are revoked

We may terminate or suspend your account for violation of these terms with reasonable notice, except in cases of severe abuse where immediate action is necessary.

13. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in the courts of New South Wales.
